Action by the plaintiff [Mrs.] Neomi Wood to recover damages for personal injuries sustained in a motor vehicle accident against
the defendant Indemnity Insurance Company of North America, carrier of the automobile liability insurance covering the vehicle
in which plaintiff was riding as a guest passenger. Mrs. Wood and her husband, James F. Wood, resided in the village of Thiensville in Ozaukee county and owned a summer cottage
on a lake in Vilas county. On May 28, 1953, at about 12:30 p. m., a station wagon jeep towing a two wheeled trailer loaded
with luggage, equipment, and supplies, was being operated by Mr. Wood northerly on Highway 45 a mile or so south of Three
Lakes in Oneida county, and Mrs. Wood was a passenger in such jeep. At such time and place the jeep left the highway and crashed
head-on into two trees outside the limits of the highway. The first persons to arrive on the scene of the accident after it
happened found the dead body of Mr. Wood stretched out on the ground not far from the jeep, and Mrs. Wood sitting on the ground
in a near unconscious condition crying and moaning with pain, as she had sustained very serious injuries. There was a fire
burning in the cushions of the front seat of the jeep, under the hood of such vehicle, and in the nearby grass.
